Terms of Service

By using Konkon, you are entering into a legally binding agreement. Please read these terms carefully as they govern your access to and use of our platform and automated WhatsApp ordering engine.
1. Acceptance of Terms
By accessing or using the Konkon platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these terms.
2. The Konkon Service
Konkon provides a technical integration layer for the WhatsApp Business API. Our Service automates the collection of orders, processing of payments via Paystack, and coordination of delivery riders. Konkon is a technology platform and does not produce food, sell inventory, or directly employ delivery riders unless explicitly stated.
3. Vendor Obligations
As a Vendor on Konkon, you agree to:
- Provide accurate information regarding your menu items, pricing, and business hours.
- Maintain high standards of food safety and quality for all orders fulfilled through the platform.
- Keep your WhatsApp Business number active and responsive to customer inquiries initiated through the Service.
- Comply with all local tax and business licensing requirements in Nigeria.
4. Fees, Payments, and Payouts
Service Fees: Konkon charges a transaction fee (as specified in your dashboard) for each successful order. These fees are deducted automatically from the payment before settlement.
Settlement: All payments are processed by Paystack. Payouts are settled to your designated bank account on a rolling basis (typically T+1 or as configured in your dashboard). Konkon is not responsible for delays caused by banks or the payment processor.
5. Delivery and Rider Dispatch
Konkon provides an automated dispatch system. While we strive to match all orders with available riders (either your own or pool riders), we do not guarantee the availability of a rider at any given time. Liability for the items during transit remains with the vendor or the assigned delivery partner.
6. Intellectual Property
You retain ownership of all content you upload to the Service (logos, menu descriptions). By using Konkon, you grant us a non-exclusive, worldwide license to use, display, and distribute your content solely for the purpose of providing the Service.
7. Termination
You may stop using our Services at any time. Konkon reserves the right to suspend or terminate your access to the platform if you violate these terms, engage in fraudulent activity, or fail to meet the service level standards expected by customers.
8. Limitation of Liability
IN NO EVENT SHALL KONKON, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SERVICE.
9. Indemnification
You agree to defend, indemnify and hold harmless Konkon and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
